These Terms of Service ("Terms") govern your access to and use of the JobStorm AI website at jobstorm.ai and any services provided by JobStorm AI, a registered trade name (DBA) of Enhanced Evolution, LLC ("we," "us," or "our").
By visiting our website, submitting a contact form, booking a demo, or entering into a service agreement with us, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
JobStorm AI provides done-for-you AI voice agent services to roofing and HVAC contractors in the Dallas-Fort Worth area. Our services include:
We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with reasonable notice to active clients.
Our services are intended for licensed business owners and their authorized representatives. By using our services, you represent that you are at least 18 years of age and are authorized to enter into a binding agreement on behalf of your business.

By providing your phone number and opting in through our website or contact forms, you consent to receive SMS messages from JobStorm AI regarding your inquiry, demo scheduling, service updates, and related communications.
Message frequency: Varies based on your inquiry and service activity.
Message and data rates may apply depending on your mobile carrier plan.
Opt-out: Reply STOP at any time to unsubscribe. Reply HELP for assistance or contact rick@jobstorm.ai.
We do not share your mobile number with third parties for marketing purposes. SMS opt-in consent is never sold or transferred.
Service fees are billed on a monthly basis as outlined in your service agreement. Payment is due on the billing date specified in your agreement. We accept payment via the methods listed in your service agreement.
Failure to pay may result in suspension of service after reasonable notice. All fees are in U.S. dollars.
JobStorm AI offers the 30-Day Promise to new clients. If JobStorm AI does not capture at least one incremental booking that you would not have otherwise received within the first 30 days from the date your AI agent goes live, JobStorm AI will provide an additional 30 days of service at no charge, during which Rick will personally re-tune the call flow to address performance issues. Every lead captured by the AI agent during the promise period remains yours to keep.
The 30-Day Promise extension may be invoked once per client lifetime. To invoke, the client must contact JobStorm AI at rick@jobstorm.ai within 30 days of the agent going live and identify at least one specific aspect of agent performance to be addressed during the re-tune period. The extended 30-day period of complimentary service begins the day Rick confirms the re-tune scope with the client.
The one-time setup fee (currently $1,500) is non-refundable once the kickoff session has been completed and custom call flow build work has begun. The setup fee compensates for labor expended on building a call flow specific to your business, which cannot be reused for other clients. If you cancel before the kickoff session is held, the setup fee will be refunded in full minus any incurred third-party costs.
Monthly service fees are non-refundable except as provided under the 30-Day Promise above, or where required by law.
You may cancel service at any time with no early termination fees and no long-term contracts. To cancel, email rick@jobstorm.ai from the email address on your account. Service will continue through the end of your current billing cycle (no pro-rated refunds for partial months), and your AI agent will be decommissioned within 7 days of cycle end.
JobStorm AI reserves the right to terminate service for any client in violation of these Terms or for non-payment after reasonable notice.
All content on the JobStorm AI website — including text, design, graphics, and code — is owned by or licensed to JobStorm AI and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without express written permission.
AI agent configurations, scripts, and logic developed by JobStorm AI for your account remain the intellectual property of JobStorm AI. You retain ownership of your business data, call recordings from your account, and any materials you provide to us for agent setup.
Our services are provided "as is" and "as available." We make no warranty that our AI voice agents will be error-free, uninterrupted, or will capture every inbound call under all circumstances. AI agent performance depends on factors including network conditions, caller behavior, and the quality of information provided during setup.
JobStorm AI is not responsible for missed revenue resulting from technical outages, carrier disruptions, or circumstances beyond our reasonable control.
To the fullest extent permitted by law, JobStorm AI and its owner shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to lost profits, lost revenue, or data loss.
Our total liability to you for any claim arising from these Terms or our services shall not exceed the total fees paid by you in the three months preceding the claim.
You agree to indemnify and hold harmless JobStorm AI and its owner from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of our services, your violation of these Terms, or your violation of any applicable law or third-party right.
Our SMS communications program is limited to the following approved use cases:
We do not use SMS for unsolicited marketing, promotional broadcasts, or any communications unrelated to your inquiry or active service. All SMS messages are sent only to individuals who have expressly opted in through our website contact forms.
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Collin County, Texas, and you consent to the jurisdiction of those courts.
We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page. Continued use of our website or services after changes are posted constitutes acceptance of the updated Terms. We will notify active clients of material changes via email.
